Email Hosting Terms of Service

This Email Terms of Service agreement ("Agreement") outlines the rules and conditions for using the services provided by Maildep Ltd ("Services"). "You" and "Your" refer to the individual or entity using these Services, or anyone authorized to act on your behalf. By using the Services, you agree to follow all the terms outlined here, as well as any additional policies, including, but not limited to general common hosting services and, Acceptable Use Policy available in the Legal section of the Maildep Ltd website. This policy is considered part of this Agreement. Your continued use of the Services implies your acceptance of all these terms and conditions.

GENERAL USE STATEMENTS
1. Account Activation

You understand that for the Services to be operational, they must be associated with a domain name. By purchasing the Services, you confirm that the domain name either belongs to you or that you have the necessary access rights. Maildep Ltd may assist with the account setup if a timely request is made to the support team.

2. Usage Restrictions and Account Limits

You acknowledge that Maildep Ltd may impose general usage limits, including the number of days email messages are stored, restrictions on incoming and outgoing emails, the maximum size of emails or attachments, and the total disk space allocated to you. Maildep Ltd is not responsible for the deletion or failure to store any messages sent or received via the Services. You also agree that Maildep Ltd reserves the right to adjust these limits at its discretion, as outlined in the 'Modification Terms' section of this Agreement.

Your email account is subject to specific limitations based on your subscription plan, such as:

  • Starter: 500 emails/hour per domain
  • Professional: 1000 emails/hour per domain
  • Ultimate: 1500 emails/hour per domain
3. AI-Powered Services Disclaimer

Our AI Paid Plans utilize the powerful services provided by OpenAI and Microsoft Azure. These services, including access to ChatGPT and other AI models, are powered by external providers. Any issues related to the availability, performance, or functionality of these services fall under the responsibility of OpenAI and Microsoft Azure, respectively. While we offer seamless integration into our platform, Maildep Ltd is not liable for disruptions, downtimes, or limitations in the functionality of these third-party AI services. Each plan grants access to the corresponding number of tokens, which are shared between all your mailboxes. These tokens are used to interact with OpenAI’s ChatGPT API, and usage limits are strictly governed by OpenAI’s pricing and policies. Maildep Ltd is merely a facilitator of these services. Any concerns or issues regarding the functionality or pricing of OpenAI or Microsoft Azure should be directed to them directly. We cannot be held responsible for any modifications or interruptions in these services.

4. Storage and Security

You are responsible for maintaining the security of your account and password. Maildep Ltd will not alter your password without proof of identity. In case of disputes (such as a divorce or partnership breakup), Maildep Ltd will remain neutral and may suspend your account until the issue is resolved. Maildep Ltd will not be held liable for any losses arising during such disputes.

All risks regarding loss, damage, and security of your email account and content rest with you. You must take adequate measures to prevent loss or damage to your content, and ensure the security and confidentiality of your emails and passwords. Maildep Ltd is not responsible for any loss or misuse resulting from a breach of these responsibilities.

5. Content

You are solely responsible for all content you upload, email, or otherwise transmit via the Services. Maildep Ltd does not control the content transmitted and does not guarantee its accuracy, integrity, or quality. You may be exposed to offensive or objectionable content while using the Services, but Maildep Ltd is not liable for any damages resulting from such exposure.

6. Backups

Maildep Ltd performs daily backups of Service data, retained for 14 days. However, no guarantee is made regarding the integrity of these backups. Backups are solely for server restoration and internal purposes. It is your responsibility to keep local copies of your content. If data loss occurs due to Maildep Ltd's error, attempts will be made to recover the data free of charge. If the loss is due to your actions, recovery may be attempted from the most recent backup.

USER OBLIGATIONS AND PREVENTATIVE MEASURES
1. Prohibited Activities

By using the Services, you agree not to misuse them. Prohibited actions include:

  • Violating any applicable laws or regulations.
  • Attempting unauthorized access to Maildep Ltd's website, servers, or other customers' accounts.
  • Launching denial-of-service attacks or other invasive procedures against Maildep Ltd servers or others' networks.
  • Uploading or transmitting harmful materials like malware, spam, or illegal content.
  • Engaging in actions that could harm Maildep Ltd or other users, such as IP blacklisting or DDoS attacks.

Maildep Ltd reserves the right to refuse service or take corrective actions if these rules are violated. Any content deemed offensive or illegal will be removed immediately, and violations may lead to account suspension or termination without refund. Maildep Ltd has sole discretion over corrective actions, and its decisions are final.

PAYMENT TERMS
1. Payment Cycle

Your billing cycle begins when you purchase the Services. If you selected the automatic renewal option, Maildep Ltd will renew your Services and charge the payment method you provided according to the current rates.

2. Renewal Terms

Renewal fees are in accordance with the fee schedule in effect at the time. If you fail to pay on time, your email account may be locked, limiting access to the Services. You are responsible for renewing the Services before expiration. Maildep Ltd will notify you of the renewal, but you must ensure the accuracy of your contact details.

3. Failed Renewal Fees and Service Restoration

If you fail to pay within 30 days after the billing date, Maildep Ltd may terminate your account, deleting all content. Reactivation will require full payment. Maildep Ltd will make reasonable efforts to restore your data, as outlined in the 'Backups' section.

CANCELLATION AND REFUND TERMS
1. Termination Policy

You may cancel the Services by submitting a request at least three (3) working days before renewal. Maildep Ltd may also terminate your account at any time for violations of this Agreement, or if your use places unreasonable demands on Maildep Ltd's resources.

In case of termination, no prepaid fees will be refunded. Maildep Ltd may take control of any domain associated with your terminated account. If the termination is due to your default, you will bear the termination costs.

2. Refund Policy

Fees for private email hosting are non-refundable, unless a refund is requested within 7 days of the charge and is approved by Maildep Ltd. This applies to new purchases or renewals of paid services.

MODIFICATION TERMS

Maildep Ltd reserves the right to modify or discontinue the Services at any time, with or without notice. You agree to be bound by any changes made to this Agreement and continue using the Services after such modifications.
