2. User Obligations

You are responsible for ensuring that your use of our Services complies with all applicable laws and regulations. You must not upload or share content that infringes intellectual property rights, promotes illegal activities, or violates our Terms of Service. By using our Services, you agree to grant us permission to cache content on our servers as necessary to deliver the Services.

3. Service Interruptions

While we strive to provide reliable and uninterrupted Services, there may be instances of downtime due to maintenance, natural disasters, or other unforeseen circumstances. Maildep, Ltd. is not liable for damages resulting from service interruptions or delays. Our liability is limited to the total fees paid for the Services during the affected period.

4. Account Responsibilities

You are responsible for maintaining the security of your account and ensuring compliance with this Policy by all users of your account. Account transfers require prior written approval from Maildep, Ltd. Unauthorized transfers or use may result in account suspension or termination.

5. IP Address Usage

Any IP address assigned to you as part of our Services remains the property of Maildep, Ltd. and is provided solely for your use during the term of the Services. We reserve the right to reassign or revoke IP addresses at our discretion.

6. Payment and Billing

All fees for Services are billed monthly. Failure to pay on time may result in account suspension or termination. Refunds are only issued in accordance with our refund policy, and additional charges may apply for overdue accounts or data recovery requests.

7. Prohibited Activities

Users of our Services must not engage in activities including, but not limited to:

  • Sending unsolicited bulk or commercial emails (SPAM).
  • Hosting content that is illegal, harmful, or violates intellectual property rights.
  • Engaging in activities that harm our infrastructure, such as denial-of-service attacks or the distribution of malware.
  • Using our Services for any activity that violates applicable laws or regulations.

8. Anti-Spam Policy

You must comply with all relevant anti-spam laws and regulations, including the CAN-SPAM Act. Sending unsolicited emails or failing to maintain accurate opt-in records is strictly prohibited. Violations may result in account suspension, termination, or additional charges.

9. Email Usage Limits

To ensure optimal performance, email usage is subject to limitations, including hourly sending limits and restrictions on forwarders. Detailed usage limits are outlined in our Service documentation.

10. Policy Violations

Maildep, Ltd. reserves the right to investigate and address violations of this Policy. Accounts found in violation may face suspension, termination, or additional penalties. Backup data may not be retained for terminated accounts.

9. Storage and Security

  • You are responsible for the security, confidentiality, and maintenance of your server and all content stored on it.
  • Ensure the following:
    • Protect your server content from loss or damage.
    • Maintain independent backups of your data.
    • Ensure the security and integrity of any data transmitted or stored on Maildep servers.
  • Maildep services are not intended for backup or archival purposes. Usage primarily for storage may result in termination without notice.
  • Maildep does not provide a PCI-compliant environment. You are responsible for compliance if required.

10. Transfer of Content

Upon service termination, you must transfer your content off Maildep servers. Maildep will not assist with the transfer or management of your data.

11. Third-Party Software

  • Maildep may provide access to third-party tools or software on an "as-is" basis without guarantees of specific results.
  • You may install compatible third-party software, but usage is at your own risk, including responsibility for any associated licenses or fees.

12. Maildep Rights

  • Maildep reserves the right to modify pricing, limits, and service guidelines.
  • Services may be suspended or terminated for:
    • Harassment or illegal activities.
    • Non-payment of fees.
    • Violations of applicable laws or policies.
  • Maildep may monitor service use at its discretion.

13. Limitation of Liability

  • Services are provided "as-is," without warranties of merchantability, fitness for purpose, or non-infringement.
  • Maildep is not liable for:
    • Data loss or corruption.
    • Service interruptions or errors.
    • Losses from unauthorized account use or external factors like natural disasters.

14. Indemnification

You agree to defend, indemnify, and hold Maildep harmless from claims, damages, or liabilities arising from:

  • Misuse of the services.
  • Violation of intellectual property rights.
  • Data breaches or misrepresentation on your part.

15. Copyright and Trademark Claims

Maildep respects intellectual property rights and reserves the right to remove infringing content.

Notices of infringement must include:

  • A signature of the rights holder or authorized agent.
  • Identification of the infringed material and infringing content.
  • Contact details of the complainant.
  • A statement of good faith and accuracy under penalty of perjury.

16. Termination and Suspension

Maildep may suspend or terminate access for reasons including, but not limited to:

  • Compliance with legal obligations.
  • Suspected fraud or abuse.
  • Harm to Maildep’s reputation or operations.

17. Governing Law

This agreement is governed by the laws of United Kingdom. Disputes must be resolved in the courts of the United Kingdom.

18. Final Provisions

  • Unenforceable provisions will be replaced with enforceable terms that reflect the original intent.
  • This agreement constitutes the full understanding between you and Maildep.
